Payment Terms


These are the payment terms (referred to as "Payment Terms") governing financial transactions conducted via TaskSouq, the freelance services marketplace located at our operational address. TaskSouq is managed by TaskSouq Ltd., a company headquartered London.


Please carefully review these Payment Terms before engaging in any financial transactions on TaskSouq. When you make or receive payments on our platform, you, whether individually or on behalf of your employer or another relevant entity, hereby acknowledge and agree to be bound by these Payment Terms. It is important to note that these Payment Terms are complementary to TaskSouq's General Terms of Service, which encompass the broader framework of our platform's operations.


Key Definitions For the purposes of these Payment Terms, certain terms are defined as follows:


  • TaskSouq Balance: This refers to the cumulative amount of your earnings as a Task Provider, any refunded payments resulting from cancelled orders as a Task Buyer.
  • Payment Services Provider(s): These are third-party entities that facilitate payment-related services for both Task Buyers and Task Providers on the TaskSouq platform. These services encompass the collection of funds from Task Buyers for their purchases, the transfer and withdrawal of funds to Task Providers, currency exchange services related to payments and withdrawals in local currencies, and the temporary holding of funds associated with TaskSouq Balances.
  • Earnings: Earnings signify the monetary compensation Task Providers receive for successfully completed tasks, which can subsequently be withdrawn or utilised for purchases within the TaskSouq ecosystem, in accordance with the stipulations outlined in these Payment Terms.


Receiving Payments


General

  1. Earnings Calculation: For each task (referred to as a "Task") successfully sold and completed on TaskSouq, your account will be credited with earnings equal to 85% of the total purchase amount.
  2. Payment Upon Completion: TaskSouq disburses earnings to Task Providers upon the satisfactory completion of an order. Please refer to the "Orders" section in our Terms of Service for a comprehensive definition of a completed order.
  3. Cancellation Refunds: In the event of order cancellation for any reason, the funds paid will be refunded to the Task Buyer's TaskSouq Balance.
  4. Tax Obligations: Task Providers bear the responsibility for settling any direct or indirect taxes, including VAT, GST, or income tax, as may be applicable based on their residency, location, or other relevant factors within their jurisdiction. Task Providers hereby declare and guarantee that they are in compliance and will continue to comply with all tax obligations stipulated under the income tax laws of their respective jurisdictions. The price displayed on the Task  order page includes all such taxes and charges that may be applicable to Task Providers.
  5. Limited Payment Collection Agent: Task Providers appoint TaskSouq as their authorised payment collection agent for the sole purpose of accepting payments from Task Buyers (via our Payment Services Provider, when applicable) and transferring those payments to Task Providers. Task Providers acknowledge that payments made by Task Buyers to TaskSouq shall be deemed equivalent to payments made directly to the Task Providers themselves. The Task Buyer's payment obligation to the Task Provider is considered fulfilled upon TaskSouq's receipt of payment (or its Payment Services Provider, as applicable), and TaskSouq (via its Payment Services Provider, as applicable) is responsible for remitting the funds to the Task Provider in accordance with the provisions outlined in these Payment Terms. In instances where TaskSouq (via its Payment Services Provider) fails to remit such amounts to Task Providers, Task Providers shall seek recourse solely against TaskSouq, and not against the Task Buyer directly. Task Providers consent to TaskSouq's right to describe or otherwise communicate the terms outlined herein in any terms of service, receipts, disclosures, or notices, including but not limited to receipts furnished to Task Buyers, as TaskSouq deems necessary or prudent.
  6. Payment Services Providers: TaskSouq collaborates with Payment Services Providers to facilitate the collection of payments from Task Buyers, the transfer of these payments from Task Buyers to Task Providers, and the secure handling of funds associated with TaskSouq Balances. All payment-related services pertaining to the withdrawal of funds on the TaskSouq platform are carried out by TaskSouq's Payment Services Providers.


Withdrawing Revenues

  1. Withdrawal Account Requirement: To initiate the withdrawal of your earnings, you must maintain an account with at least one of TaskSouq's Payment Service Providers, as specified in the withdrawal methods detailed below. All funds eligible for withdrawal will be securely held on your behalf in an account managed by TaskSouq's Payment Services Provider. It's important to note that all payment services, including withdrawal services, will be facilitated exclusively by TaskSouq's Payment Services Provider.
  2. Account Association: Your TaskSouq profile is permitted to be linked with only one account from each withdrawal method offered by TaskSouq. Similarly, a Payment Service Provider withdrawal account can be associated with just one TaskSouq profile.
  3. Withdrawal Timing: Earnings are made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order has been marked as completed. However, Top Ranked Sellers benefit from an accelerated withdrawal process, allowing them to access their earnings after a safety clearance period of 7 days following order completion.
  4. Withdrawal Process: Task Providers can initiate the withdrawal of their earnings using one of TaskSouq's withdrawal options (please refer to the Withdrawal Section below for details on payment terms). To initiate the withdrawal process, you must select the designated withdrawal provider.
  5. Security Measures: For security considerations, TaskSouq reserves the right to temporarily suspend a Task Provider's ability to withdraw earnings to prevent fraudulent or illicit activities. Such actions may be taken in response to security concerns, reported improper behaviour by other users, or the association of multiple TaskSouq accounts with a single withdrawal provider.
  6. Withdrawal Amount: Withdrawals can only be made in the amount of earnings available to you in your TaskSouq Balance.
  7. Withdrawal Fees: Please note that withdrawal fees are subject to variation based on the chosen withdrawal method.
  8. Irreversible Withdrawals: Once the withdrawal process has been initiated, withdrawals are considered final and cannot be reversed. TaskSouq will be unable to reverse this process once it is underway.
  9. Currency Considerations: In certain scenarios, Task Providers may withdraw earnings in various currencies. All currency exchange services related to such withdrawals are conducted by TaskSouq's Payment Services Providers. Your TaskSouq Balance is always calculated based on its GBP£ value. Consequently, the local currency amount of your TaskSouq Balance may fluctuate daily in response to exchange rate changes, and this may include associated conversion fees. Task Providers always retain the option to withdraw earnings in GBP£.
  10. Recovery of Disabled Accounts: In cases where Task Providers have disabled accounts, they will be eligible to withdraw their earnings after a safety period of 90 days, provided full verification of ownership of the relevant account has been completed. This period is measured from the day of the last cleared payment received in the account and is subject to TaskSouq's approval.


Withdrawal Methods

TaskSouq offers various withdrawal methods to cater to your preferences:

  1. PayPal Account: You can opt to withdraw your earnings to your PayPal account with a nominal fee of GBP£0*. To find a list of PayPal services available by country, please refer to this link.
  2. Local Bank Transfer (LBT): TaskSouq offers the Local Bank Transfer option, allowing you to withdraw your earnings for a fee of GBP£3 per transfer*. This option is accessible to users worldwide.

*Please be aware that additional fees may be applicable based on your location and the currency you are operating with.

Purchasing


General

  1. Order Placement: TaskSouq facilitates the purchase process, where Task Buyers pay for services by creating an order through a Task Provider's Task page or Custom Offer. This can be done using the "Order Now" button. TaskSouq collaborates with Payment Services Providers to manage the collection of all payments from Task Buyers, transferring these payments from Task Buyers to Task Providers, and securely holding funds within TaskSouq Balances. All payment services related to the collection of funds on the TaskSouq platform are administered by TaskSouq's Payment Services Providers.
  2. Payment Collection Agent: TaskSouq acts as the limited authorized payment collection agent for Task Providers, exclusively for the purpose of receiving payments from Task Buyers (via its Payment Services Provider, when applicable) and disbursing those payments to Task Providers. Task Buyers fulfil their payment obligation to Task Providers upon TaskSouq's receipt of payment (or its Payment Services Provider, as applicable), and TaskSouq (via its Payment Services Provider, as applicable) assumes responsibility for transferring the funds to the Task Provider in accordance with the provisions outlined in these Payment Terms. In the event that TaskSouq (via Payment Services Provider) fails to transmit such funds to Task Providers, the Task Provider's recourse lies solely against TaskSouq and not against the Task Buyer directly.
  3. Accepted Payment Methods: In most regions, Task Buyers can make purchases on TaskSouq using one of the following payment methods: Credit Card, PayPal, TaskSouq Credits, or an existing TaskSouq Balance. Additional payment methods may be available in specific locations.
  4. Service Fees: Service fees are applied at the time of purchase, allowing you to review and accept the total amount due. These fees cover administrative costs. As of June 2023, the service fees amount to 5.5% of the purchase value. For purchases under GBP£75, an additional small order fee of GBP£2.5 will be levied.
  5. Utilization of TaskSouq Balance: Your existing TaskSouq Balance will be automatically applied to your next purchase, simplifying your transaction process.
  6. Payment Method Restrictions: Task Buyers are prohibited from offering or using any payment method other than those provided through the TaskSouq.com site. If you are asked to employ an alternative payment method, please report it immediately to our Customer Support.
  7. Electronic Invoices and Receipts: You consent to receiving invoices and/or payment receipts from TaskSouq in electronic form as PDF documents, delivered via email or through the TaskSouq site.
  8. Payment Information and Privacy: To safeguard against fraud, unauthorized transactions (e.g., money laundering), claims, or other liabilities, payment information related to withdrawals is collected either by TaskSouq or TaskSouq's Payment Services Providers. Payment Services Providers may also collect additional information necessary for processing withdrawal payments. TaskSouq does not have access to the payment information provided to Payment Services Providers, and this data is subject to the privacy policy applicable to the respective Payment Service Provider.   9. Representation and Warranty: By using any payment method and/or providing payment details for making purchases on TaskSouq, you affirm and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have obtained the necessary permissions to make payments using the selected payment method(s); (c) if you are an employee or agent of a company or individual that owns the payment method, you have authorization from that company or individual to use the payment method for TaskSouq transactions; and (d) such actions are in compliance with all applicable laws.


Local Currencies

  1. Payment in Various Currencies: TaskSouq offers the convenience of making payments in a variety of currencies. To facilitate ease of use, prices are rounded up to the nearest whole number. During the checkout process, you will see the exact amount to be paid. Unless explicitly stated otherwise, you will be charged in the currency displayed on the payment page. All currency exchange services related to payments in local currencies are carried out by TaskSouq's Payment Services Providers. However, in specific instances where certain currencies are not supported by particular payment methods, you may be charged in GBP£ even if the price is displayed in another currency. Regardless, the actual charged amount (in the designated payment currency) will be clearly disclosed to you prior to completing the payment.
  2. Currency Price Calculation: It's important to note that all prices on TaskSouq are always derived from their original GBP£ price. Consequently, non-GBP£ currency prices may fluctuate daily in response to exchange rate variations and may also include associated conversion fees. Task Buyers always retain the option to pay in GBP£ by adjusting their selected currency.
  3. Cancellation and Refunds: In the event that you paid for an Order in a currency other than GBP£ and the Order is subsequently cancelled for any reason, the amount returned to your TaskSouq Balance will be based on the exchange rate as of the date of cancellation. Consequently, the refunded amount may differ from the initially paid amount in local currency terms while consistently maintaining the same GBP£ value.
  4. TaskSouq Balance Currency: It's essential to understand that your TaskSouq Balance is always valued in GBP£, irrespective of the currency in which it is displayed. Therefore, if you choose to view your TaskSouq Balance in a currency other than GBP£, it may fluctuate daily in accordance with exchange rate changes while preserving the same GBP£ value. Users always have the option to view their TaskSouq Balance in GBP£ by modifying their selected displayed currency.


Taxes

TaskSouq may be obligated under relevant laws to impose indirect taxes, such as Sales VAT, Tax, or GST, on users or withhold taxes as necessary. Any amount TaskSouq is required to collect will be in addition to the purchase amount and any other applicable fees paid by the Task Buyer. Similarly, any amount TaskSouq is obligated to withhold will be deducted from the Task Provider's revenue, as mandated by the applicable laws.

Indirect taxes are additional charges beyond the price displayed on the site. In any case, TaskSouq will always transparently present any such taxes to the Task Buyer before the payment is made. Users are responsible for settling any direct or indirect taxes, including VAT, GST, or income tax, that may be applicable to them based on their residency, location, or other relevant factors within their jurisdiction.


Disputes and Cancellations

We strongly encourage our Task Buyers and Task Providers to make efforts to resolve disputes among themselves. If, for any reason, these efforts fail, even after utilizing the Resolution Centre or in cases of non-permitted usage on the TaskSouq platform, users can seek assistance from TaskSouq's Customer Support department.


Key Points

  • Order cancellations, when eligible, can be initiated on TaskSouq either by TaskSouq (through Customer Support or other means) or through the Resolution Centre on a per-order basis.
  • Initiating a transaction dispute or initiating a payment reversal through your payment provider or bank is considered a violation of these Payment Terms. Such actions may result in temporary or permanent account suspension. Please note that once a dispute has been filed with your payment provider, the funds become ineligible for a refund, in accordance with our obligations to the payment provider.
  • In the event of issues related to a service provided within an order, users are encouraged to use TaskSouq's dispute resolution tools to attempt resolution.
  • TaskSouq, acting through its Payment Services Provider, reserves the right to cancel orders or place funds on hold in cases of suspected fraudulent transactions on the platform.
  • The transfer and assignment of intellectual property to the Task Buyer are contingent upon full payment, and the delivery of intellectual property may not be used if payment is cancelled for any reason.
  • If an order is cancelled for any reason, the funds paid will be returned to the Task Buyer's TaskSouq Balance.
  • Task Providers may offer revisions based on their respective Task and customer care policies, which may include specifying the number of revisions they are willing to provide, including none.
  • Requests for revisions can be made through the Order Page while the order is marked as "Delivered."
  • It is not permissible to request additional services from Task Providers beyond the agreed-upon requirements by using the "Request Revisions" button.


Order Cancellations

TaskSouq promotes amicable resolutions for service-related disputes between Task Buyers and Task Providers through the Resolution Centre.

The eligibility for requesting an order cancellation on TaskSouq will be evaluated by TaskSouq, taking into account various factors, including violations of our Terms of Service and/or our Community Standards, instances of general misconduct, and improper utilization of TaskSouq's delivery system. Specifics on order eligibility are outlined below:


  • Completed orders (or, where applicable, completed milestones) may be cancelled, following review by our Customer Support team, within a timeframe of up to 14 days after the order (or Milestone) has been marked as complete. It's important to note that orders cannot be partially cancelled; only the entire order can be cancelled when warranted.
  • In exceptional circumstances where it is deemed appropriate, our Customer Support team may cancel a completed order even after 14 days have elapsed since its completion. In such instances, the funds paid for the cancelled order will be returned to the Task Buyer's TaskSouq Balance and deducted from the Task Provider's TaskSouq Balance. If there are insufficient funds in the Task Provider's TaskSouq Balance, the deduction will be made from their future revenues.
  • Orders cannot be cancelled based on the quality of service/materials provided by the Task Provider if the service aligns with the description on the Task Page. Task Buyers can provide feedback on their experience with the Task Provider on the Order Page, including their assessment of the overall quality of service received.
  • Task Buyers must use the TaskSouq Resolution Centre to address concerns and desired resolutions related to the service provided by the Task Provider before contacting Customer Support. Customer Support will not take any action on orders in cases where the Task Buyer has failed to communicate issues related to the Task Provider's service and will allow the Task Provider to propose a resolution first. This excludes non-permitted usage of TaskSouq.
  • Any instances of non-permitted usage of TaskSouq identified during an order, following a review by our Customer Support team, may lead to the cancellation of the order. This encompasses, but is not limited to, actions such as harassment, unlawful behaviour, or other violations of TaskSouq's Terms of Service.


TaskSouq may cancel orders for a variety of reasons, including but not limited to the following, in the following scenarios:


For active orders (after requirements were submitted to the Task Provider and before the Task Provider delivers on TaskSouq):

  1. The Task Provider is late and unresponsive for more than 24 hours while the order is marked as Late.
  2. Users engage in abusive behaviour towards each other, including threats of low ratings or the misuse of order materials (e.g., logins, personal information) against each other.
  3. Users supply or include materials that infringe on copyright or trademark rights as part of their requirements or the Task Provider's delivery.
  4. The user is no longer an active TaskSouq user due to violations of the Terms of Service or the closure of their account.


Delivered Orders (after the Task Provider clicks "Deliver Now" and before the order is marked as complete):

  1. The Task Provider employs the Delivery system to extend the delivery due date, thereby delaying the final delivered service without providing the completed service. Please note that repeated violations of this nature will result in the permanent suspension of your TaskSouq account.
  2. The Task Provider delivers no files and/or proof of work pertaining to the agreed-upon order requirements. The assessment of the material's relevance will be conducted by our Customer Support team.
  3. The Task Provider solicits additional payments, either on or off the TaskSouq platform, by withholding the final delivery of services directly linked to the agreed requirements.
  4. The Task Provider withholds the final delivery of services in an attempt to obtain improved ratings.
  5. Users misuse the "Request Revisions" button to acquire additional services from Task Providers beyond the agreed-upon requirements.
  6. Users resort to threats of leaving a damaging review in an attempt to coerce Task Providers into providing services unrelated to the agreed requirements.


Completed Orders (after the order is marked as complete and before the 14-day limitation):

  1. Users who have been reported for using copyrighted or trademark-infringing materials after verification and with supporting evidence.
  2. Users who did not purchase commercial use rights and are reported to have used the materials for commercial purposes. Please note that the terms of commercial use are outlined on the Task Provider's Task Page and cannot be retroactively included once the order is completed for over 14 days.
  3. TaskSouq Customer Support will evaluate cases of Order delivery manipulation that prevent users from fully utilizing our Resolution Centre, which is designed to enable the order to be marked as complete.


Chargebacks

TaskSouq reviews instances of payment provider chargebacks and disputes on behalf of Task Providers. While the outcomes can vary depending on the specific reason for the chargeback, we are dedicated to resolving disputes in favour of the Task Providers. If the chargeback case permits, TaskSouq (or one of TaskSouq's Payment Services Providers) will reimburse the Task Provider either in part or in full. In cases where the chargeback amount cannot be reimbursed to the Task Provider, the Task Provider will bear the chargeback amount.


Refunds

  • TaskSouq does not automatically refund payments made for cancelled orders back to your payment provider. Funds resulting from order cancellations are returned to the Task Buyer's TaskSouq Balance and are available for future purchases on TaskSouq.
  • Refunds from the Task Buyer's TaskSouq Balance (i.e., refunds directly to your payment provider) can be requested from the billing page. The refund process will be based on your payment method(s), amount, and currency. To prevent fraud and misuse, we impose limits on the number of times users can request a payment provider refund, which is subject to review by our Customer Support team. Such refunds may be subject to an additional fee.
  • Task Providers may choose to offer a partial refund for a specific order to the Task Buyer. Upon the Task Buyer's acceptance of such a partial refund, the amount will be automatically refunded to the Task Buyer's payment method. In cases where TaskSouq cannot refund the agreed-upon amount to the Task Buyer's payment method, the amount will be added to the Task Buyer's TaskSouq Balance.


Modifications:

TaskSouq may make changes to these Payment Terms periodically. When such changes occur, TaskSouq will provide an updated version of the terms on this page.

You acknowledge and agree that if you continue to use TaskSouq after the effective date of the revised Payment Terms, TaskSouq will consider your use as an acceptance of the updated Payment Terms.

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER TASKSOUQ NOR ANY PERSON ASSOCIATED WITH TASKSOUQ MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.


Limitation on Liability

Under no circumstances shall TaskSouq, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any damages of any nature, whether arising under any legal theory, related to or in connection with your use or inability to use the TaskSouq website, any websites linked to it, any content on the TaskSouq website or such linked websites, or any services or items obtained through the TaskSouq website or such linked websites. This includes, but is not limited to, any direct, indirect, special, incidental, consequential, or punitive damages, such as personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, whether caused by tort (including negligence), breach of contract, or otherwise, even if such damages were foreseeable.


The above limitation on liability does not affect any liability that cannot be excluded or limited under applicable law.


For the purpose of these terms, the term "Affiliate" refers to an entity that, either directly or indirectly, exercises control over TaskSouq, is under the control of TaskSouq, or is under common control with TaskSouq. Control, in this context, implies possessing more than fifty percent (50%) of the voting stock or other ownership interest, or the majority of voting rights of such entity.
